ANGOLA — A Fremont man was ordered to pay $427,000 to the victims of a 2017 car-buggy crash.
The Steuben Circuit Court room was full of supporters Monday morning when Brady Duvendack, 24, was sentenced by Judge Allen Wheat. He admitted to a Level 6 felony, operating while intoxicated causing serious injury.
Another Level 6 felony, two misdemeanors and an infraction alleging driving while suspended were dismissed.
A Level 6 felony carries up to a 2 1/2-year jail sentence. Wheat sentenced Duvendack to 1 1/2 years and suspended it all. Duvendack will be on probation 1 1/2 years.
Duvendack rear ended a horse-drawn carriage on Ray Road, south of C.R. 750N, the evening of Aug. 16, 2016. All four occupants of the carriage were ejected and Benjamin Schmucker, 13, of Montgomery, Michigan, was flown from the scene by Samaritan Helicopter with multiple injuries.
Reuben Schmucker, 22, of Montgomery, was transported to Parkview Regional Medical Center by Steuben County EMS. Noah Schmucker, 18, and Jonathon Schmucker, 23, who was driving the carriage, were treated and released at the scene.
According to testimony in court, Duvendack and his family came to the aid of the injured family and have helped them through their recovery from the injuries. The Duvendacks have helped the Schmuckers in various ways through the ordeal.
